Agreement to Terms

Welcome to Schengen Safe. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our service.

These Terms constitute a legally binding agreement between you ("you" or "user") and Material Labs LLC, operating as Schengen Safe ("we", "us", or "our"). Please read them carefully.

Description of Service

Schengen Safe is a web-based application that helps users track their stays in the Schengen Area to ensure compliance with the 90/180 day rule. Our service includes:

• Trip tracking and management
• Automated Schengen compliance calculations
• Visual timeline and calendar views
• Travel history export (PNG and CSV formats)
• Multiple passport tracking
• Trip verification tools

Schengen Safe is provided as an informational tool. While we strive for accuracy, you are solely responsible for ensuring your compliance with immigration laws.

Account Registration

Eligibility

You must be at least 18 years old to use Schengen Safe. By creating an account, you represent that you meet this age requirement.

Account Security

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You may not share your account with others or allow others to access your account. You are responsible for maintaining the confidentiality of your login credentials.

Subscription and Payment Terms

Free Trial

New users receive a 7-day free trial with full access to all features. You must provide payment information when signing up, but you will not be charged during the trial period. The trial allows you to:

• Test all features with no limitations
• Cancel at any time during the trial without charge
• Evaluate whether Schengen Safe meets your needs

If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.

Subscription Plans

After the trial period, Schengen Safe operates on a subscription basis:

• Monthly subscription: Billed monthly at the current rate
• Annual subscription: Billed annually at a discounted rate

Current pricing is displayed on our website. We reserve the right to change subscription prices with 30 days notice to existing subscribers.

Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you:

• Authorize Stripe to store your payment information
• Authorize us to charge your payment method for subscription fees
• Agree that your payment method will be automatically charged on each billing cycle
• Accept Stripe's Terms of Service

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

Failed Payments

If a payment fails:

• We will attempt to charge your payment method multiple times over several days
• You will receive email notifications about the failed payment
• Your subscription may be suspended if payment is not received
• Your account and data will not be deleted during a payment failure period

Cancellation and Refund Policy

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. When you cancel:

• You will retain access to paid features until the end of your current billing period
• No further charges will be made to your payment method
• Your account will automatically convert to read-only access after the billing period ends
• Your trip data will be retained for 1 year in case you wish to reactivate

Refund Policy

Our refund policy is as follows:

• During Free Trial: Cancel anytime with no charge. No refund is necessary as you have not been charged.
• Monthly Subscriptions: Prorated refunds are available if you cancel within 14 days of your billing date. Refunds are calculated based on unused days in the billing period.
• Annual Subscriptions: Prorated refunds are available if you cancel within 30 days of your billing date. Refunds are calculated based on unused months.
• After Grace Period: No refunds are provided for cancellations made after the grace period, but you retain access until the end of your billing period.

To request a refund, contact us at support@schengensafe.com. Refunds are processed within 5-10 business days.

Exception: Violation of Terms

No refunds will be issued if your account is terminated for violation of these Terms of Service.

Acceptable Use

When using Schengen Safe, you agree NOT to:

• Use the service for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Use automated means (bots, scrapers) to access the service without permission
• Reverse engineer, decompile, or disassemble any part of the service
• Remove or modify any copyright or proprietary notices
• Share your account credentials with others
• Use the service to transmit viruses, malware, or harmful code
• Impersonate any person or entity
• Collect or store personal data of other users
• Use the service in any way that could harm our reputation or business

Violation of these acceptable use terms may result in immediate termination of your account without refund.

User Content and Data

Your Data

You retain all rights to the travel data you enter into Schengen Safe. By using our service, you grant us a limited license to:

• Store and process your data to provide the service
• Use your data to calculate compliance and generate reports
• Create anonymized, aggregated statistics for service improvement

We will never sell your personal data or share it with third parties except as described in our Privacy Policy.

Data Accuracy

You are responsible for:

• Entering accurate trip information
• Keeping your travel history up to date
• Verifying the accuracy of our calculations
• Ensuring compliance with immigration laws

Schengen Safe is a tool to assist you, but you are ultimately responsible for your own immigration compliance.

Data Backup

While we perform regular backups, we recommend that you export your travel history periodically for your own records. We are not liable for any data loss.

Intellectual Property

Schengen Safe, including all content, features, functionality, code, design, graphics, and user interface, is owned by us and protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the service
• Reproduce or distribute any part of the service
• Use our trademarks, logos, or branding without permission
• Frame or mirror any part of the service

Disclaimer of Warranties

PLEASE READ THIS SECTION CAREFULLY.

Schengen Safe is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability, fitness for a particular purpose, or non-infringement
• That the service will be uninterrupted, timely, secure, or error-free
• That the results obtained from use of the service will be accurate or reliable
• That the quality of the service will meet your expectations
• That any errors in the service will be corrected

Schengen Safe is an informational tool only. We do not guarantee the accuracy or completeness of any calculations, and we are not responsible for any immigration violations or penalties that may result from reliance on our service.

You should always verify compliance with official sources and consult with immigration professionals when needed. We strongly recommend consulting embassy websites, immigration lawyers, or official border control agencies for authoritative guidance.

Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY.

To the maximum extent permitted by law, Schengen Safe and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of business opportunity
• Immigration violations, fines, penalties, or legal consequences
• Denied entry or deportation
• Travel disruptions or expenses
• Emotional distress or other intangible losses

This limitation applies whether the claim is based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising from your use of Schengen Safe shall not exceed the amount you paid us in the 12 months prior to the event giving rise to the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Schengen Safe and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

Account Termination

Termination by You

You may terminate your account at any time by:

• Canceling your subscription in account settings
• Requesting account deletion through account settings or support

Upon termination, your data will be retained according to our data retention policy (see Privacy Policy).

Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your payment method fails repeatedly
• We are required to do so by law
• We discontinue the service

We will make reasonable efforts to notify you before termination, except in cases of serious violations or legal requirements.

Effect of Termination

Upon termination, your right to use the service immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Changes to Service

We reserve the right to modify, suspend, or discontinue any part of Schengen Safe at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the service. We are not liable to you or any third party for any modification, suspension, or discontinuance of the service.

Changes to Terms

We may revise these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you via email (for significant changes)
• Display a prominent notice in the application

Your continued use of Schengen Safe after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the service and cancel your subscription.

We recommend reviewing these Terms periodically for any updates.

Governing Law and Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

Dispute Resolution

If you have a dispute with us, you agree to first contact us at support@schengensafe.com to attempt to resolve it informally. We will make good faith efforts to resolve disputes amicably.

Arbitration

If we cannot resolve a dispute informally, any dispute shall be resolved through binding arbitration in accordance with the rules of JAMS (Judicial Arbitration and Mediation Services). The arbitration shall take place in San Francisco, California.

You agree that any arbitration shall be conducted on an individual basis, not as a class action or representative proceeding.

Exceptions to Arbitration

Either party may seek relief in small claims court for disputes within its jurisdiction. Additionally, either party may seek injunctive relief in court to protect intellectual property rights.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Schengen Safe and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

No Third-Party Beneficiaries

These Terms are between you and Schengen Safe only. No third party is intended to benefit from these Terms.

Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, or network failures.
